This website is operated by Sieger Group. Throughout the site, the terms "we", "us" and "our" refer to Sieger Group. Sieger Group offers this website, including all information and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here. By visiting our site, you engage in our "Service" and agree to be bound by the following terms and conditions ("Terms of Service", "Terms"). Sieger Group reserves the right to cancel or change programs. A liability waiver must be signed upon commencement. The following general terms and conditions apply. However, specific terms and conditions for certain programs take precedence over our General Terms and Conditions.

 

Please read these Terms and Conditions carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms and Conditions. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms and Conditions are considered an offer, acceptance is expressly limited to these Terms and Conditions. Any new features or tools which are added to the current website shall also be subject to the Terms and Conditions. You can review the most current version of the Terms and Conditions at any time on this page. We reserve the right to update, change or replace any part of these Terms and Conditions by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

 

Section 1: Conditions of Participation

Sieger Group reserves the right to alter the route, itinerary or activities of any of its programs and arrange alternative transport carriers to those advertised if necessary. No refunds will be given in these circumstances or in the event of any delay, curtailment or alteration of a program resulting from any cause including severe weather conditions or other external factors. Sieger Group cannot guarantee pick-up or drop-off times and is not liable for participants failure to connect with other services. Sieger Group accepts no responsibility for loss of or damage to personal belongings or baggage.


Section 2: Intellectual Property

Sieger Group is the owner and/or permitted to use of all Intellectual Property Rights (including without restriction trademarks, service marks, patents, copyrights, database rights and all other Intellectual Property Rights) appearing on or contained within the Site, unless otherwise indicated. You acknowledge and agree that use of the Site does not grant to you any right of use or interest in any Intellectual Property Rights in the Site. Except as provided in these Site Terms & Conditions, any use or reproduction of such Intellectual Property Rights by you is prohibited and to do so is a breach of these terms and may infringe the Intellectual Property Rights of third parties or our Intellectual Property Rights.


Section 3: Copying

You may view this Site and print hard copies of content, information or material appearing on the Site solely for your lawful, personal, non-commercial use. You agree not to copy, modify, download, reproduce, transmit, publicly perform, distribute, adapt, translate, modify, bundle, merge, store, sell, share or make available to any person, any such content, information or material, or use it for any commercial purposes. All other rights are reserved.


Section 4: Indemnity and Release of Liablity

You hereby forever release and discharge Sieger Group and its employees, officers, and directors (referred to as the “Facilitator”) from any claim, lawsuit, demand, or expense whatsoever (all of which are referred to as “claims”) by reason of any damage or injury done to myself or my property, including my death.

 

4.1. Hazards: You aware that the Outdoor Team Building program which includes High Rope, Low Rope, Obstacle Course, Trekking, Rock Climbing, Zip Line, Fire walk, Glass walk, Water Sports, Archery, Safari, Zorbing, Camping, Team Building Games and other similar activities (refered as 'Adventure and Team Building Activities') by Facilitator involve certain hazardous risks. These risks are inherent in the nature of the activities because they involve confronting and overcoming fears, phobias, and limitations. During the workshop or other activities, you will not participate in anything you do not feel comfortable doing or you are prepared to do in regardless of other’s participation or non-participation.

 

You fully understand that all activities presented for involvement are optional and participation in them is not necessary to receive benefit from the experience. If you do participate in certain activities which involve risk of injury, you take full responsibility for my actions and any negative consequences resulting there from. Adventure and Team Building Activities may be dangerous or hazardous and may result in possible injury or death.

 

You agree to abide by the instructions given by Facilitator to discontinue playing immediately upon the feeling of any unease, disoriented, or experiencing any lack of well-being or due to any medical reasons that arise during the entire participation of Outdoor Activities. You understand that Adventure and Team Building Activities during the workshop is entirely voluntary and you will not attempt Adventure and Team Building Activities or any other activity unless you choose to do so.

 

The components of the Adventure and Team Building Activities and other similar activities include discussion, participation, other personal growth activities, and OPTIONAL by workshop participants. The risks involved in the workshop may include the following, but are not limited to; falls, pain, soreness, burns, blisters, mental or emotional upset, and disorientation. You authorize the use of your photos, video, name, comment, game result, etc. for promotional purposes by Sieger Group.

 

4.2. Indeminity: Whilst Sieger Group makes every effort to safeguard its clients, Sieger Group cannot be held responsible for personal injury or loss due to events which are beyond its control. Participants should note that adventure and outdoor activities (Outbound training, team building) involve a higher than normal risk. You further agree to indemnify (assume all costs of) the Facilitator against all costs and expenses associated in any way with any claim made by you or by any person claiming through you, including the minors. This release and indemnity is given in consideration of your participation in the activities offered by the Facilitator and shall be effective whether or not the damage, injury, or death arose from or was contributed to by:

 

A. The negligence of the Facilitator
B. The actions of the other clients
C. Any other cause whatsoever

 

You understand and agree to follow all safety rules, regulations & procedures and in the event that such rules and procedures not followed by yourself, or others, it could result in your injury or death. Furthermore, programs may include the services of transport providers and other suppliers/operators, and Sieger Group cannot be held responsible or liable for these.


Section 5: Fitness Requirements

Our Unique Team Building Programs and Corporate Training & Events may sometimes be challenging and physically demanding for some people. It is, therefore, important that all participants have a reasonable level of fitness in order to successfully participate in our outdoor team building programs. Please take note of the level of physical strength required for the various programs and discuss it with your team members. Programs are modified to suit the ability of each group, if you are aged 15-65 and you are not unfit or don’t have any serious health problems, there should be no difficulties. However, if you have any doubts, please call Sieger Group on +91 7550053010 prior to your team building program and we will do everything in our power to accommodate you.


Section 6: Children

Children aged 0-5 are generally not permitted to participate in Sieger Group adventure programs. Children aged 6-15 (inclusive) must be accompanied by an adult and must be capable of completing the program with minimal assistance from Sieger Group staff. This is up to the discretion of Sieger Group staff. Please check individual program terms and conditions for program specific information or contact us.


Section 7: Weather Conditions and External Circumstances

Sieger Group does not take any responsibility for the weather, or outcomes that result from it. Day programs will usually always operate in all conditions. Your guide will do their best to ensure you have a great time and get the most out of it, but it’s also recommended that you prepare accordingly and bring a sense of adventure. Cancellation/transfer fees and conditions apply if you choose to change your plan based on the weather. Deposits will not be refunded due to weather.

 

However, Sieger Group also reserves the right to cancel or amend programs due to adverse weather conditions. In the case of bad weather, we’ll advise you of our contingency plans. Based on this, at your discretion, the date can be rescheduled or the deposit can be used as credit towards another experience.

 

Sieger Group shall not be responsible or liable for events that are outside of our control, thus not liable for any external events influencing the successful performance of a program (including but not limited to any act of terrorism, war, political insurgence, insurrection, riot, civil unrest, act of civil or military authority, uprising, earthquake, flood or any other natural or man made eventuality outside of our control, which causes the termination of an agreement or contract entered into, nor which could have been reasonably foreseen).


Section 8: Media: Usage of Photos/Video for Marketing Purposes

Unless otherwise advised, it is a condition of particpation that consent is given for Sieger Group to capture, review and share photographs, videos, feedback and your logo (use any media like photography/videography/audio) created during the program. This includes full Sieger Group copyright, and the consent that they be used for all purposes, e.g. To inform others about Sieger Group's services and products, including on our website, social media and other marketing. For this permission not to be granted, Sieger Group requires this to be expressed writing prior to program. If you are granted Shared Copyright of Sieger Group created media, credit must remain with www.siegergroups.com.


Section 9: Training Courses and Requirements

Sieger Group will design and deliver training for the duration, date(s) and fee stated on the enclosed invoice.

 

9.1. Scope: We consider the following out of scope:

 

(a) Venue and delegate transportation, which you will organise and provide.

 

(b) Provision of materials (excluding delegate workbooks) after the event which may be used as part of the training delivery days (e.g. Business games), which remain Sieger Group’s property.

 

9.2. Additional Learning Requirements: Should any of the course delegates have any particular learning requirements, these should be notified to Sieger Group in advance of course delivery through email only.


Section 10: Availability

All programs and prices based on the availability of Sieger Group, its various resources, and the availability of Venues/Suppliers.


Section 11: Quotes and Acceptance

Unless otherwise stated, quotes are valid for 15 days. On the basis of dates and availability, the cost of a program could be subject to change. You cannot cancel an accepted order except following the Sieger Group's written agreement which may be on terms that indemnify the Sieger Group against all its loss (including loss of profit), costs, damages and expenses (if any) incurred by the Sieger Group as a result of cancellation.


Section 12: Prices

The price is exclusive of any applicable Goods and Services Tax ("GST") or other taxes or duties payable by the Customer and GST shall be charged, where appropriate, at the rate prevailing at the relevant tax point. The Company's GST registration number is 33AIWPR8684H1ZA. The price excludes the cost of delivery, which will be subject to an additional charge to the Customer.


Section 13: Deposit

50% deposit is required at time of booking due to the preparation required; this deposit is non-refundable.


Section 14: Payments

Payment in full is due no later than 7 days prior to the event date. This may be made via electronic transfer, debit card, cheque or credit card (3% fee - 4% on AMEX). The company reserves the right to cancel the event if payment has not been received in full. A monthly interest of 5% may be charged on outstanding invoices.


Section 15: Transferring, Exchanging, Selling

You are able to transfer, sell, or exchange your booking for a different Sieger Group program (minus any costs incurred to Sieger Group due to required resource allocation and/or supplier costs). At least 21 days notice must be given when changing the date of a booking.


Section 16: Cancellation & Refund Policy

16.1. If you chose to cancel your experience within 21 days of the program, Sieger Group does not offer refunds. The 50% deposit is non-refundable however we will work with you to reschedule or rebook, or you may use the deposit as credit towards another experience (minus any costs incurred).

 

16.2. In the event of illness to the team building coach/trainer(s) we reserve the right at any time to cancel the event. Should this occur, an alternative date will be offered where possible, but if this date is unsuitable, all money paid for this particular event will be refunded.


Section 17: Confirmation

Confirmation and final numbers must be completed 7 days prior to travel. Please call +91 7550053010 for final confirmation 24-48 hrs before the program.


Section 18: Confidentiality

As a service provider, Sieger Group will have access to and be entrusted with information about your business, some of which is or may be confidential. Sieger Group shall not, except in the proper course of their duties, divulge to any person or otherwise make use of any trade secret or any confidential information concerning your business or any of its transactions or affairs.


Section 19: Prohibited Uses

In addition to other prohibitions as set forth in the Terms & Conditions, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses.


Section 20: No Warranty

We (and our parent, subsidiaries, affiliates, officers, directors, agents and employees) do not guarantee continuous, uninterrupted, error free or secure access to the Site or any of Our Services, and operation of the Site may be interfered with by numerous factors outside of our control.

 

We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable. You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

 

You expressly agree that your use of, or inability to use, the service is at your sole risk. Our Site and Our Services are provided "as is" and as and when available, and to the extent permissible by law we exclude all implied warranties, conditions or other terms, whether implied by statute or otherwise, including without limitation any terms as to skill and care or timeliness of performance. All implied terms, conditions and warranties (whether statutory or otherwise) are excluded from your use of the Site and the supply of Our Services.


Section 21: Termination

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms & Conditions are effective unless and until terminated by either you or us. You may terminate these Terms & Conditions at any time by notifying us that you no longer wish to use our Services, or when you cease using our site. If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms & Conditions, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).


Section 22: Governing Law

These Terms & Conditions and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of India and jurisdiction of Chennai, Tamil Nadu.
